PROPERTY POLICY AGENT FOR NOTICE OF CLAIMED INFRINGEMENT
Midwest Internet, Inc. respects the intellectual property of others,
and may terminate a Subscriber's account that infringes on the intellectual
property rights of others or otherwise violates the law. This information
should not be construed as legal advice. If you feel that your copyrights have
been infringed upon, or if someone claims you have infringed upon their rights,
please seek legal counsel. The information below is for informational purposes
only.
Notification of claimed copyright infringement or other illegal

If you have any concerns regarding the use of copyrighted material
on any site on Midwest's servers, you must, in writing, provide Midwest's
designated agent (above) with the following:
- A physical or electronic
signature of the owner or a person authorized to act on behalf of the owner of
an exclusive right that is allegedly infringed;
- Identification/description of
the copyrighted work claimed to have been infringed or, if there are multiple
works at a single online site covered by one notice, a representative list of
such works;
- Identification/description of
the infringing material to be removed or disabled, and information reasonably
sufficient for Midwest to locate the material;
- Reasonably sufficient
information to contact you, such as address, telephone number and email
address, if available;
- A statement by you that you
have a good faith belief that the disputed use is not authorized by the
copyright owner, the owner's agent, or the law; and
- A statement by you that the
information you have provided is accurate, and under the penalty of perjury,
that you are the owner or are a person authorized to act on behalf of the owner
of the allegedly infringed upon right.
If a copyright infringement notice has been filed against you, you may,
in writing, file a counter notification with Midwest's designated agent. Such
counter notification must contain the following:
- A physical or electronic signature of the subscriber;
- Identification/description of
the material that has been removed or access has been disabled, plus the
location where the material appeared before such removal or
disabling;
- A statement by you, made under
penalty of perjury, that you have a good faith belief that the material was
removed or disabled as a result of a mistake or misidentification of the
material to be removed or disabled; and
- The subscriber's name, address,
and telephone number, plus a statement giving your consent to the jurisdiction
of the Federal District Court for the judicial district in which the address is
located, or if the subscriber's address is located outside of the United
States, for any judicial district in which the service provider may be found,
and that the subscriber will accept process from the person, or their agent,
who claims the infringement.
