Midwest Internet, Inc. Acceptable Use Policy
Midwest Internet, Inc. ("Midwest")
strives to provide the best access possible. In order to accomplish this, it is
necessary for Midwest's policies to be followed.
PLEASE READ THIS ACCEPTABLE USE
POLICY, AND ALL OTHER MIDWEST INTERNET, INC. POLICIES AND AGREEMENTS, CAREFULLY
AS THEY GOVERN THE USE OF MIDWEST'S SERVICES. CURRENT VERSIONS OF MIDWEST'S
POLICIES AND AGREEMENTS CAN BE FOUND BY CLICKING ON THE POLICIES AND AGREEMENTS

ANY OF MIDWEST'S POLICIES MAY RESULT IN ACCOUNT SUSPENSION OR
TERMINATION.
For the purposes of Midwest's
policies, the terms "transmit," "transmission," or any derivative, shall mean
"to email, upload, post, etc.." Midwest's Acceptable Use Policy
addresses, but is not limited to, the concerns of illegal use, protection of
minors, threats, harassment, fraudulent activity, forgery or impersonation,
unsolicited email, unauthorized access, network disruptions or unfriendly
activity, camping, multiple logins, and viruses. Each of these issues is
addressed below in more detail.
- Regarding Illegal Use
Midwest's services may only be used
for lawful purposes. Transmission of any material that violates, intentionally
or unintentionally, any local, state, national or international law, rule or
regulation is prohibited. This includes, but is not limited to, copyrighted
material, threatening or obscene material, or material protected by trade

- Regarding Protection of Minors
Midwest's services may NOT be used
to harm, or attempt to harm, minors in any way.
- Regarding Threats and Harassment
Midwest's services may NOT be used
to transmit material that threatens or encourages bodily harm or destruction of
property. Midwest's services may NOT be used to transmit material that harasses
others.
- Regarding Fraudulent Activity/Forgery/Impersonation
Midwest's services may NOT be used
to make fraudulent offers to sell or buy products, items or services or to
advance financial scams, including but not limited to, "pyramid schemes,"
"Ponzi schemes," and "chain letters." Subscriber shall not, nor shall
Subscriber permit or assist others to, abuse or fraudulently use the services
provided by Midwest, including but not limited to obtaining or attempting to
obtain service by any fraudulent means or device with the intent to avoid
payment; accessing, altering or destroying any information of another customer
of Midwest or any other party by any fraudulent means or device or attempting
to do so; or using the services so as to interfere with the use of Midwest's
services by other customers or authorized users or in violation of the law or
in aid of any unlawful act.
- Regarding Unsolicited Email
Using Midwest's services to transmit
unsolicited commercial email or bulk email (commercial or not) is prohibited.
- Regarding Unauthorized Access
(including, but not limited to, hacking)
Midwest's services may NOT be used
to access, or attempt to access, the accounts of others, or infiltrate, or
attempt to infiltrate, security protocols of Midwest or any third party,
regardless of whether the access, infiltration, or any attempts thereof results
in corruption or loss of data or not.
- Regarding Network Disruptions or Unfriendly Activity
Midwest's services may NOT be used
to adversely affect the ability of others to use Midwest's services or the
Internet as a whole. Subscribers are responsible for the security of their own
networks, and Midwest expressly denies any responsibility thereof.
- Regarding Long Connections/Camping
Midwest's services are intended to be used actively. Using services in a
stand-by or inactive manner is prohibited. Midwest reserves the right to
terminate any connection that it determines has had an extended period of
inactivity. If a Subscriber is logged on, he/she should be actively using
his/her computer (i.e. a Subscriber may use Midwest's services as long as
he/she is sitting at his/her computer).
- Regarding Multiple Logins
Midwest's services are not to be accessed by multiple, simultaneous
connections from the same Subscriber. Midwest reserves the right to
terminate any connection that it determines to be multiple, simultaneous
connection from the same Subscriber.
- Regarding Viruses, Trojans, Worms, Etc.
Midwest does not tolerate the
intentional distribution or transmission of software designed to cause or
attempt to cause any type of damage, annoyance, or nuisance to other persons,
data or systems.
Subscriber agrees to indemnify,
defend, and hold harmless Midwest from any claims resulting from Subscriber's
use of Midwest's service that caused any damage to Subscriber or any third
party.
Use of any information obtained
using Midwest's service is at Subscriber's own risk. Midwest specifically
denies any responsibility for the accuracy or quality of information obtained
through its services. Use of other networks or computing resources is subject
to the respective permission and usage policies of those networks or computing
resources.
Midwest, or other relevant
authorities, may determine inappropriate usage of any account and the privilege
of Subscriber's use of Midwest's services may be revoked at any time at
Midwest's sole discretion. Midwest will notify Subscriber of such revocation
online.
